Contracts concluded through the site gubertini.com fall under the category of “Distance Selling Contracts” between ACETAIA GUBERTINI (hereinafter also referred to as “Company”), with registered office at Via Roma 841, 41028 Serramazzoni (MO), Tax Code MSN RNT57S52F357G, VAT No. 04033790363, and the Consumer.

These contracts concern the sale of products through online selection on the website gubertini.com.

The sale is governed by these conditions, which must be considered an integral and substantial part of the sales contract. Therefore, the Customer is invited to carefully read the sales conditions before placing an order. The Company reserves the right to update these sales conditions at any time, including for any regulatory adjustments; changes will be effective from the date of publication on the site.

The submission of the electronic order constitutes acceptance of the sales conditions in force at that time and an expression of consent to purchase.

A. MANAGEMENT OF PURCHASE ORDERS

Order management takes place according to the following phases:

1. Submission of the completed order in the appropriate section of the site by the Customer.

2. Acceptance of the order by Acetaia Gubertini sent via email, containing the main information: quantity, price, payment methods, shipping costs and address, billing data.

The acceptance and processing of the order will occur only after the payment has been credited.

If the quantity of products ordered exceeds availability, the Customer will be promptly informed via email to decide whether to replace the product, modify or cancel the order (with immediate refund of any amount already paid).

The Customer is solely responsible for the accuracy of the data entered (e.g., delivery address). Minors under 18 are not authorized to place orders.

B. SALES PRICES AND INVOICING

The prices displayed on the site are expressed in € (Euro) and include VAT, containers, and packaging. Shipping costs are not included in the product price but are calculated separately.

The invoice (or fiscal receipt) will be sent to the Customer at the email address provided during the order phase. It is possible to enter the VAT number in the appropriate field during checkout.

C. SPECIAL OFFERS AND COUPONS

The conditions related to special offers, promotions, and discount coupons will be indicated from time to time on the site or through dedicated communications.

D. PAYMENT METHODS

Payment can be made by Credit Card, PayPal, or Advance Bank Transfer.

E. SHIPPING AND DELIVERY

Shipping generally occurs within 48 hours of receiving the order (or credit in the case of a bank transfer). Delivery times vary from 2 to 10 days depending on the destination, barring unforeseen circumstances.

IMPORTANT: Check upon delivery

Upon delivery, the Customer is required to check the integrity of the package.

If the packaging appears damaged, wet, or if there is a sound of breakage, it is mandatory to sign with the wording “ACCEPTED WITH SPECIFIC RESERVATION” (indicating the reason, e.g., “punctured package”, “wet packaging”). Without this wording on the courier’s document, it will not be possible to request refunds for transport damage.

Transport costs for Italy start from €15. For abroad, they vary based on weight and destination and are calculated in the cart.

F. RETURN POLICY, REFUNDS, AND RIGHT OF WITHDRAWAL

Our goal is to ensure excellence. However, dealing with food products in glass, we have established precise procedures to protect the customer.

1. Damaged Goods (Breakages)

If you receive damaged goods, it is NOT necessary to send back the shards.

Send a report to acetaia@gubertini.com within 24 hours of delivery, attaching clear photos:

• Of the external package (and label).

• Of the damage to the packaging.

• Of the broken product.

Only after verifying the photos (and the presence of the “Control Reservation” if the damage was visible externally), Acetaia Gubertini will proceed at its sole discretion with a refund or resending of the product.

2. Right of Withdrawal (Change of Mind)

The Customer has the right to withdraw without any penalty and without specifying the reason within 14 days of receiving the products.

Exclusion: For hygienic and health protection reasons, the right of withdrawal is excluded for opened, uncorked bottles or with the guarantee seal removed or tampered with.

To exercise the withdrawal:

1. Write to acetaia@gubertini.com expressing the intention to withdraw.

2. Return the products intact and in the original packaging to: Acetaia Gubertini, Via Roma 841, 41028 Serramazzoni (MO).

3. Return shipping costs are borne by the Customer.

4. The refund will be made within 30 days of receiving the intact goods. If the goods return broken due to insufficient packaging by the customer, the refund will not be issued.

3. Non-conforming Products

In case of serious organoleptic defects, cork the bottle and contact acetaia@gubertini.com to arrange for the collection and analysis of the product.

G. APPLICABLE LAW AND JURISDICTION

The contract is governed by Italian Law (Legislative Decree 206/2005 Consumer Code and subsequent amendments).

For any disputes arising from the interpretation or execution of these conditions, the Court of Modena will have exclusive jurisdiction.
